It's all down to the MoT testers discretion though, what your brother doesnt think is a fail might be to another tester, hence my dad (mot tester all his life) didn't think there was anything wrong with the ami's suspension last week, the tester at the garage (again, tester for years) thought it was.

Another example, last year I got an advisory on a wheel bearing, this year there was no mention of it, The bamboo and my yellow car both passed MoT's with the exhaust that I had on the ami which was deemed too loud, made the self same noise but what one tester thinks is ok can be unacceptable to another.

I don't know when the cut off for emisions tests is, but pre 1970 A-series cars are cooler anyway.

IIRC a tester can refuse to test a car if they want?
