James if you go to the doctors and you don’t like what you hear you can ask for a second opinion. The legal profession have a similar problem, in that each of them may interpret a ruling in a slightly different way. That’s how appeal courts can overturn convictions, because the law can often be interpreted, or applied inconsistently.

When I mentioned earlier that; “Though rain and wind may enter a King cannot” that obviously doesn’t apply to someone making bombs in a flat above the local chippy. No one here would deny the Police, having gained reasonable suspicion, and a warrant, to go and check the place out. It’s for our own safety, and thus falls within their remit.

What concerns me is the recent use of Police officers to accompany Bailiffs.
Remember Bailiffs only collect money on behalf of the government. They collect unpaid council tax, outstanding fines, unpaid TV license from pensioners, that sort of thing. But these are not criminal offences, they are civil matters. CCJ's. No Police need attend.

Often, although there is no crime or criminal matter at hand, and Police resources are stretched, uniformed Policemen are accompanying the bailiffs. Ostensibly this is to 'prevent a breach of the peace' occurring, but in practice it is to aid the bailiff gain access to your home, thus negating your lawful right to refuse access. This could be viewed as subverting the law.

The worrying thing is the presumption that it is the householder who will cause the breach of the peace, yet unless the bailiff attempts to enter forcibly and aggressively there should be no such risk.

It used to be that the only people who could enter your home without permission were the Customs and Excise.

Now they have been merged with the Inland Revenue does that mean even tax inspectors can enter your home at will?

Knightly, in the Blair New Labour era they entered so many new statutes it makes your head spin. The government continually move the goalposts, which is why I say that statutes are open to abuse.

I believe there is now a list of additional persons that can (in theory) enter your home at will. I haven't seen it, but the way things are going I half expect the local lollypop woman to be on it.

Under section B subsection C (only if it's raining)

And for those of us that are still here, look what just happened. :shock:

“The Government recently passed legislation allowing bailiffs working for private companies to enter your home by force and restrain you to recover valuables to pay off debts.”

So that's government legislation, passed to allow a couple of heavies from a profit making private business (wheel clampers?) to forcibly enter your home and restrain you, (and presumably the wife) while they take all your possessions. And all this after slyly removing your age old right to deny access to Bailiffs. See how it works? Hey, thinking about it, Korea's just like that... maybe I've no need to go there after all!

See what I mean about statutes and moving the goalposts? How could that possibly have been tested in law as Policeman Pete maintains? And how do such intruders differentiate between 'your' goods and the trombone that Uncle Charlie left behind the sofa?

Now that makes me wonder how such a statute can be enforced? And how are the Police supposed to square the serving of two masters? No wonder they just started attending with them! Maybe that's why they're so thin on the ground these days - they're busy being rented out as a private army for businessmen!

I'll explain.

All UK Police Officers swear this "Attestation"

"I, Dibble of Dobble, do solemnly and sincerely declare and affirm that I will well and truly serve the Queen in the office of constable, with fairness, integrity, diligence and impartiality, upholding fundamental human rights and according equal respect to all people; and that I will, to the best of my power, cause the peace to be kept and preserved and prevent all offences against people and property; and that while I continue to hold the said office I will to the best of my skill and knowledge discharge all the duties thereof faithfully according to law."

The Attestation, or policeman’s oath is sworn to the Queen, who is the head of state.

As sovereign among a sovereign people, a people who are remember - IN LAW, her equals, the oath then, is to serve the people, from whence the Queen derives her powers. It is an oath to become a ‘public servant’. Those sworn duties are to keep the peace, and to protect us from offences against property and people. It says so in the oath.

I’ll jog you memory here, who was it again the Policeman just swore his oath to? Was it to us - or the Bailiff? He didn’t swear to “Help a private business pursue its aims of collecting revenue, and in so doing help that company make a fat profit’.

So how can that work? If a Policeman is a public servant, and a 'for profit' business is plainly not the public, then who's side is he supposed to be on? By oath? The side of the public. But in reality? Well how does is look to you?

Something's seriously fucked up here guys, and that's why people like me are going off on one, while those that are sworn to defend us are sat drying their tears of laughter.

It's only the first of December today innit! Cracked open door number one on my Lego advent calendar. Happy days. I bastard love Christmas, it's brilliant, although this year flew past a bit quick, maybe it just feels like that because I'm getting older. Planned my entire Saturday morning around spending the whole winter heating budget on the biggest tree I can wedge in/on/through my van and taking the nipper to see father Christmas, who, by the way is real because I met him last year. Anyways, I'm proper buzzin about it and I will have no bah humbug style 'I don't like/celebrate/believe in Christmas' nonsense here. Christmas is great. Where's me mulled wine?
